Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Cardish platform operated by Cardish ("we", "our", or "us") at https://cardish.io. By creating an account or using Cardish, you agree to these Terms.

1. Description of Service

Cardish is a digital networking platform that allows professionals to:

• Scan and digitize business cards using optical character recognition (OCR).
• Store and manage contact information collected at events and meetings.
• Send personal follow-up SMS text messages and emails to contacts.
• Share a digital contact card via QR code or direct link.

2. Account Registration

To use Cardish, you must create an account using a valid email address. You are responsible for:

• Providing accurate and complete registration information.
• Maintaining the confidentiality of your password.
• All activity that occurs under your account.

You must be at least 18 years old to create an account. Cardish reserves the right to suspend or terminate accounts that violate these Terms.

3. SMS Messaging Terms

Cardish enables users to send SMS text messages to contacts. By using the SMS features of Cardish, you agree to the following:

3a. Consent Requirement

You may only send SMS messages to individuals who have voluntarily provided you with their phone number and have indicated willingness to receive follow-up communications from you — for example, by exchanging a business card or contact information at a networking event or meeting. You must not send unsolicited messages.

3b. Message Types

SMS messages sent through Cardish must be personal, professional follow-up communications. Permitted uses include:

• Post-meeting follow-ups and introductions.
• Sharing your digital contact card.
• Scheduling follow-up calls or meetings.

You may not use Cardish to send:

• Spam, bulk promotional messages, or unsolicited marketing.
• Harassing, abusive, threatening, or illegal content.
• Content related to sex, hate speech, firearms, alcohol (to minors), tobacco, or illegal substances.
• Phishing, malware, or fraudulent content.

3c. Message Frequency

Message frequency varies by user. Cardish does not send automated recurring messages on your behalf without your direct action. Typically, messages are one-time follow-ups per contact.

3d. Opt-Out

All message recipients may opt out at any time by replying STOP to any message. Upon receiving STOP, no further messages will be sent to that number from your account. You must honor all opt-out requests immediately.

3e. Help

Recipients may reply HELP for assistance. For support, contact msg@cardish.io.

3f. Message & Data Rates

Standard message and data rates may apply to SMS messages depending on the recipient's mobile carrier and plan. Cardish is not responsible for carrier charges incurred by message recipients.

3g. Carrier Compliance

SMS messages are delivered via Twilio, Inc. You agree to comply with Twilio's Acceptable Use Policy and all applicable carrier guidelines. Cardish reserves the right to suspend SMS access for any account found to be in violation of these policies.

4. Acceptable Use

You agree not to:

• Use Cardish for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to other users' accounts or data.
• Reverse engineer, copy, or redistribute the Cardish platform.
• Upload malicious code, viruses, or any content that could damage the platform or its users.
• Use automated bots or scripts to access the platform.

5. Intellectual Property

The Cardish platform, its design, and all associated content are the intellectual property of Cardish. You retain ownership of the contact data and content you add to your account. By using the platform, you grant Cardish a limited license to store and process your data solely to provide the service.

6. Data & Privacy

Your use of Cardish is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Cardish, you consent to the data practices described in the Privacy Policy.

7. Disclaimers

Cardish is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that OCR results will be accurate. You are responsible for reviewing and correcting any contact information extracted by the scanning feature.

8. Limitation of Liability

To the fullest extent permitted by law, Cardish shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to messages sent to contacts, data loss, or unauthorized account access.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, abuse of the SMS features, or any activity that harms other users or the platform. You may delete your account at any time by contacting msg@cardish.io.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after updates are posted constitutes your acceptance of the revised Terms. Material changes will be communicated to registered users by email.

11. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.
